The south is rising up and making waves, setting a new precedent for patients to access medical marijuana legally. It’s another state to jump on the green wave.
The first dispensaries and sales took place Friday, April 29th, 2023, which patients waited 8 long years for. It has been legal for patients to possess and use cannabis oil in Georgia, but no place to buy it legally.
Flaws in the system include a fixed level of medicine availability. Only 6 producers are allowed to cultivate, and any cannabis oil manufactured must be low THC in potency. Two universities will also be allowed to produce and conduct research.
Only 5 dispensaries will be allowed to open via cultivators licenses. Thus far, the state only has licensed two companies to grow, manufacture and sell.
In March, Georgia rejected a bill that would have expanded the program allowing for more business opportunities and regulated delta-8 products. Nine companies filed lawsuits after losing bids for licenses. The bill would have set provisions for dealing with those lawsuits. It also would have regulated hemp derived CBD products as well.
With only 5 licensed producers/dispensaries, and mandating vertical integration, medicine is sure to be scarce. We will see how long it takes for them to actually expand their program meaningfully.

In Oklahoma News, another lawsuit has been filed against OMMA, the Oklahoma Medical Marijuana Authority, and Metrc, the state’s contracted track and trace program that licensees are mandated to use.
The lawsuit, filed in Ottawa Thursday May 4th, 2023, with the plaintiff being Full Tilt, LCC states that injunctive relief is sought due to the fact that Metrc’s contract with OMMA does not include licensees paying for their RFID tracking tags nor does it include the monthly service fee of $40 per month imposed on businesses as a deliverable.
What they’re saying is, if it’s a deliverable, then it should have been included in the contract and Request for Proposal, which it does not. If it’s not considered a deliverable then licensees shouldn’t be required to pay for tags and service fees. Metrc’s bid to OMMA states that the annual fee from Oklahoma to Metrc for the contract is $42,500, which includes all operating costs covered.
The lawsuit also states that the reason Full Tilt, LLC is suing was due to an inspection taking place that resulted in an Emergency Order of Suspension because plants weren’t tagged. They also stated that they never received a copy of their inspection report before receiving the suspension notice. This happened after rumors of OMMA going around imposing arduous and excessive fines in an attempt to shut down licenses.
The lawsuit is headed up by Ron Durbin, an attorney in Oklahoma who has sued Metrc and OMMA before on behalf of medical marijuana licensees. It’s ever so curious that he allegedly did not show up for the last injunctive hearing where Metrc countersued to move the venue from Muskogee to Oklahoma county. The result of which was an immediate implementation of Metrc’s track and trace into effect and Metrc included a back charge to all licenses. Businesses were essentially extorted where Metrc required them to pay the last year’s worth of service fees, even though it was not required by law to utilize Metrc during that time. If they didn’t pay, access was cut off to Metrc’s required software.
Businesses are expected to pay $0.25 per package tag and $0.45 per plant tag for growers in addition to the $40 monthly service fee. Other licenses that are in states like California and Missouri do not have to pay these fees, the Metrc compliance fee is assumed by the state and tags are supplied to licensees at no cost. It is assumed with the high cost of licensing that compliance should be included with that cost.
The lawsuit actually references Missouri as a case law precedent example. The licensees got together and sued, and Missouri sided with the licensees stating that they can not be charged for tags and service fees.
It’s possible that if injunctive relief is granted, it may only be granted to the plaintiff Full Tilt, LLC, until the lawsuit outcome is determined. If Oklahoma sided with the licensees it would mean businesses would not have to continue paying those fees moving forward, it seems unlikely, however, that they would get a refund on the past year of fees and tags.

Minnesota may be following in the footsteps of Missouri, and might be the next state to legalize cannabis. They already have a small medical marijuana program in place, but with bills in the House and Senate this spring, it looks likely that their medical marijuana program may quickly expand into a recreational adult-use cannabis program.
Negotiators from Minnesota’s House and Senate will need to iron out the differences between the two marijuana legalization bills.
Similarities in the bills are Minnesotans being 21 and up to acquire cannabis at licensed retailers, grow their own plants and keep a certain amount for personal use, while also expunging non-violent marijuana offenses from criminal records.
Differences in the bills include how it will be taxed, how illicit unregulated sales would be penalized and how social equity applicants will qualify.
City councilmen, citizens and even cannabis advocate and former Governor of Minnesota, Jesse Ventura bore passionate testimonies citing reason after reason why cannabis should not be illegal. Some of the facts presented include that it makes no sense cannabis is a Schedule I drug when there is documented evidence that cannabis has medical benefits, furthermore keeping it illegal does not lower the crime rates or inhibit the illicit market at all.

LOS ANGELES, CA – January 3, 2023– Steven Young is a veteran of the U.S. Marine Corps. The day after 9/11/2001, Steven went to his local Marine recruiting office and joined the service. He was combat deployed multiple times between 2002 and 2006 before being honorably discharged. His unit was regularly targeted by mortar fire in Iraq. In one incident, his commanding officer was hit in the face by enemy fire. Steven remembers the many images of death and injury which haunt him to this day. When he returned from service, he was deemed 100% disabled by the Veterans Administration.
As a result of serving, Steven suffers from “night terrors” that consist of episodes of intense fear, screaming and flailing while still asleep. The night terrors substantially impact his ability to function. Sleep is a “major life activity” and it is significantly affected by the night terrors. None of the medications prescribed were effective for Steven and so, under Illinois law, he became a medical cannabis patient. Steven reports that, when he has night terror symptoms, he uses cannabis which effectively stops the problem making it possible for him to sleep and function normally.
Steven applied and was accepted into the physical therapy training program at the College of DuPage in Glen Ellyn, Illinois. The college is a community facility funded by the state. Steven successfully completed the classroom part of the physical therapy program at the college. Thereafter, in October 2022, as he prepared to enter the practical training component, Steven tested positive for cannabis during a drug test administered to all students before entering the practical training phase. Despite providing his valid Illinois medical cannabis information, the school ejected him from the program. Steven spoke to a female student at the school who tested positive for Ritalin, an amphetamine. That student provided her valid doctor’s prescription and was allowed to continue.
Steven’s use of cannabis is limited to when he experiences the night terror issues. The cannabis has no impact on his ability to function and operate during the day. In December 2022, an appeal was made to the dean of the college who committed to looking into the matter and advocating on Steven’s behalf. Despite the appeal, Steven remains ousted from the college and the physical therapy program he successfully completed in the classroom.
Commenting on the school’s decision to eject Steven, attorney Matthew Pappas said, “The decision by the state funded college to eject Steven based on the medical cannabis prescription valid under Illinois law is discriminatory and prevents him from operating on a level playing field. He suffers from a condition that substantially limits a major life activity and cannabis effectively treats that condition.” Pappas, a California lawyer who has for many years advocated for medical cannabis patients, says the school’s policy violates rights protected by the constitution as well as Title 2 of the Americans with Disabilities Act. Pappas noted that students on much more dangerous prescription drugs are allowed to continue in the program even though cannabis is safer and more effective for Steven, “It isn’t right and Steven will file an action against the school to ensure he can complete his practical training and graduate as well as help others who have been or in the future are subjected to this kind of disability discrimination.”

Recently, the DEA issued a declaration that THC-O, Delta-8 and Delta-9 are all illegal and considered Schedule I controlled substances. This news has rippled through the cannabis community, leaving many with questions about the legality of products containing this compound.
THC-O, also known as tetrahydrocannabinol oxidase, is a compound derived from the cannabis plant. Although the compound does not cause a “high” like traditional THC, it does contain psychoactive properties. This has prompted many consumers to turn to THC-O as an alternative to traditional THC.
Delta-8 THC and delta-9 THC both exist naturally in the hemp plant, whereas THC acetate (also known as THC-O) does not.
Terence L Boos., chief of the DEA’s Drug and Chemical Evaluation Section wrote, “It can only be obtained synthetically, and therefore do(es) not fall under the definition of hemp,” THC acetate is a “controlled substance.”
The DEA’s clarification follows a U.S. 9th Circuit court decision last year that found delta-8 THC products are “hemp” and thus legal under the U.S. 2018 Farm Bill.
In 2022, Rob Kight, a North Carolina based cannabis attorney, prompted the DEA to address and clarify its stance by writing a letter to them.
Rob Kight said, “I have been concerned about the proliferation of THC acetate ester (THCO) for a while. It has always been my view that THC-O is a controlled substance under federal law. Although it can be made from cannabinoids from hemp, THC-O is not naturally expressed by the hemp plant. It is a laboratory creation that does not occur in nature, at least not from the hemp plant.”
Unfortunately, the DEA’s stance on THC-O has put this chemical compound back into illegal territory even contradicting a statement they made last year that Delta-8 is legal under the Farm Bill as long as it was derived from hemp. Now they are saying that it doesn’t matter how it was derived or where it came from, it’s all illegal.
This declaration has been met with criticism from many in the cannabis industry, others see it as an important step towards battling abuse of the substance. THC-O has been found to be especially dangerous if overdosed or when paired with certain drugs, such as alcohol. Declaring the substance to be illegal helps to protect users from potential harm.
Despite the DEA’s statement, THC-O is considered legal in some states. In states that have legalized marijuana, THC-O is often still included in formulations for sale in dispensaries. Legality for THC-O, Delta-8 and Delta-9 varies state by state.
It is clear that the issue of THC-O’s legality is far from settled. In the meantime, however, users must be aware that the DEA still considers it an illegal substance. The legalization of recreational marijuana use in the State of Oklahoma may open up a world of possibilities for those who enjoy its recreational use. The recreational legalization bill State Question 820 would allow people to buy, sell, and possess marijuana without fear of criminal prosecution. An Economic Impact Study was conducted and found that passing SQ820 would bring in nearly a billion dollars in tax revenue for the state.
The Oklahoma medical marijuana industry has seen an influx of entrepreneurs, with growers, dispensaries, and processors popping up all around the state. This industry is creating thousands of jobs and has become a major economic driver for many local communities. Several bills have come before SQ820 that haven’t made it through. SQ820 was the only bill to be rescheduled from a November election to a March election by Governor Stitt.
The legalization of recreational cannabis would also come with a number of important benefits for Oklahomans including a reduction in the medical marijuana tax and the mandatory reversing or resentencing of marijuana related crimes. The legalization of medical marijuana has already drastically decreased the number of arrests and convictions for marijuana possession. Full-on legalization would allow people with criminal records to put the past behind them and avoid the potential stigma of a felony conviction.
The recreational legalization of marijuana with SQ820 would prohibit cities from banning recreational stores, allow existing operators to have the first shot at getting recreational licenses and the tax revenue would be allocated to infrastructure. Excise tax revenues will fund implementation of the law, with any surplus revenues going to public school programs to address substance abuse and improve student retention (30%), the General Revenue fund (30%), drug addiction treatment programs (20%), courts (10%), and local governments (10%).
A local government may not limit the number of, or completely prohibit, such businesses. Persons who occupy, own, or control private property may prohibit or regulate marijuana-related conduct, with the exception that a lease agreement may not prohibit a tenant from lawfully possessing and consuming marijuana by means other than smoking.
The law would not affect an employer’s ability to restrict employee marijuana use. For the first two years, marijuana business licenses are available only to existing licensees in operation one year or more. The law would not affect the rights of medical marijuana patients or licensees.
With Missouri just having passed their legalization bill and allowing recreational cannabis purchases it seems that it’s time Oklahoma follows suit. Oklahoma would certainly be in the running to lose millions in tax dollars if patients find it easier to go to Missouri and purchase without the cost and wait of a medical card.

Twitter is making moves to capitalize on the growing popularity of the cannabis industry. Twitter officially announced that they will be allowing cannabis and CBD related promotional content on their platform. The news came on the heels of Twitter’s previous stances on cannabis related advertisements, which were previously prohibited. Twitter had previously set a policy that any company that purchased ads related to cannabis or CBD had to meet the company’s requirements for legitimate businesses.
Under the new policy, businesses will be required to only promote products and services that are legal under applicable U.S. federal and state laws. This means that companies that operate in states where cannabis and CBD products are legal will be able to advertise on the platform.
In addition to the requirements for companies to remain compliant with U.S. federal and state laws, Twitter will also require advertisers to be licensed and certified with the applicable governing body in their state. This requirement is meant to ensure that all advertisements are accurate, truthful, and not misleading. Additionally, advertisements may not appeal to children, include minors or pregnant women in the ads, or depict anyone under the influence.
Although the news is still new, the cannabis industry believes that the move by Twitter will help to legitimize the industry and open up the potential for companies to leverage their advertising platforms to reach new customer bases. As more and more states legalize cannabis and CBD products, this type of social media ad buys are only likely to increase. This could lead to a “green rush” of companies rushing to advertise their products on social media sites like Twitter.

Mystery Baking Company started the New Year by partnering with Feed the Street LA, Cookies and George Lopez Chingon bakery, to feed the people at the White House Community Center on Skid Row.
In a city where everyone is moving 100 miles an hour, Mystery Baking Company and dozens of volunteers slowed down for a day, to feed the streets.
With less then 24 hour notice the date was set for Thursday January 5th. Volunteers and those in need met on the corners of 5th st and San Pedro at 6am. Even tho the forecast for Los Angeles was 100% rainy.
At ground zero aka skid row, lines of people extended blocks while the Mystery Baking company served warm breakfast waffles.
Under the heavy rain and gloomy weather, volunteers shared smiles and made memories but most importantly, made a difference in our Community.
From humble beginnings and a rough upbringing Rafael Dos Santos, owner of Mystery Baking, along with his team, dedicated their time to help those in need.
“We tend to disregard those who are less fortunate. The Outcast. The Forgotten. We didn’t help homeless, we helped someone’s son, daughter, brother, father, mother,” said Rafael.
The impact Mystery Baking is making in the community is enormous. Certified chefs along with volunteers cooked over 600 waffles. Covered with their non-Infused spreads, every bite was filled with joy.
Topping off the smell of warm waffles in the air, Hector’s clipper Hand’s and his team of barbers showed up and showed out. They drove over 200 miles from Northern California to join Mystery Baking company at Skid Row, they provided fresh hair cuts to whomever wanted one.

At least 6500 federal prisoners are ecstatic this week with President Biden’s perfectly timed Pardon of “of all federal convictions for simple cannabis possession”, a promise made by Biden while campaigning in 2020, and kept 1 month before midterm elections.
With just weeks left before elections, the price of gas going up again, inflation at an all time high, and Biden’s popularity at an all time low, the President’s timely announcement of the pardon and his call for a sweeping reform and reclassification of cannabis has the DCC (Department of Cannabis Control), as well as most democrats up for election or reelection, also ecstatic. And it’s a logical move, seeing as the majority of the US population favors legalization of cannabis use.
From his official Twitter account, President Biden tweeted,“ As I’ve said before, no one should be in jail just for using or possessing marijuana. Today, I’m taking steps to end our failed approach.” He continued,“ There are thousands of people who were previously convicted of simple possession who may be denied employment, housing, or educational opportunities as a result. My pardon will remove this burden.” Biden added,“ We classify marijuana at the same level as heroin—and more serious than fentanyl, it makes no sense.”
The pardons clears people who were convicted of simple possession of marijuana under federal law between 1992 and 2021. The approximate 6500 prisoners did not include the District of Columbia, airports and national parks, which would have greatly increased the number of pardons.
Biden also announced he has ordered an expedited review of how marijuana is scheduled under federal law — a move that could change how the drug is regulated in the United States and could help guide criminal laws. This would mean taking cannabis off the Schedule 1 drug list. To this end Biden asked Health and Human Services Secretary Xavier Becerra and Attorney General Merrick Garland to “expeditiously” review how marijuana is scheduled under federal law. As a Schedule 1 drug, marijuana is currently in the same classification as heroin and LSD; Biden said,” even higher than the classification of fentanyl and methamphetamine – the drugs that are driving our overdose epidemic.”
There are a few caveats of his sweeping pardon proclamation:
The majority of US marijuana convictions are prosecuted at a state level, as a result, those convictions are not included in this Pardon as Biden does not have the authority to do so. He said he is reaching out to the Governors to request their help freeing those convicted of simple cannabis use. Colorado Governor Jared Polis had this to say on Twitter:
The pardon also does not cover people with federal convictions for other marijuana-related crimes like trafficking or people who were not in the U.S. legally at the time of their offense.
Only those convicted before October 6, the day on record of his Pardon, will be eligible.
His move on Thursday did not decriminalize the drug and it remains a federal crime to possess small amounts of marijuana on federal land, which still leaves many open to being arrested for possession charges.
Precedent of the Pardon – Does Biden have the Authority?
Biden recently announced a student loan forgiveness program of up to 20,000 per student, as of yet the applications have not been distributed for the student loan forgiveness program. Since the announcement, the program requirements for loan forgiveness has changed who gets their loans forgiven, as the President does not have the power to forgive loans that were federally funded, but transferred to private corporations for collections. Thus denying thousands of students expecting forgiveness.
In somewhat the same way, this “Pardon all” story may take a while to play out fully since the power of the pardon is not all encompassing. For instance, could President Donald Trump, after his impeachment, pardon himself? The answer is no! The impeachment would strip him of that power! There is precedent for Biden’s action, however many of his opponents are saying he doesn’t have the authority to pardon everyone.
But even so, the pardon power is one of the strongest unilateral authorities of the presidency, as show in these past examples the power of the Pardon:
Jimmy Carter’s amnesty for Vietnam War draft dodgers
1974 Gerald Ford preemptively pardoned Richard M. Nixon, who had resigned the presidency in the wake of the Watergate scandal (He receives backlash for the pardon called ” the most notorious pardon in history.”)
In 1795 George Washington set aside the death sentences of two ringleaders of the Whiskey Rebellion.
Thomas Jefferson made an “offer of pardon” to insurgents so that it “may restore the tranquility of the commonwealth.”
Abraham Lincoln and Andrew Johnson both offered and issued conditional proclamations of amnesty relating to the Civil War
And more recently Barack Obama used his clemency powers to shorten more than 1,700 individual’s prison terms he thought were harshly skewed by mandatory minimum sentences that punished nonviolent crimes
A Historic Move
Although some of these historical pardons are somewhat similar to Biden’s actions, the impact is quite massive. It’s the most significant step a U.S. president has taken to loosen federal marijuana laws, following the footsteps of increasingly more states that have moved to decriminalize marijuana in recent years.
This Pardon is a big story and it will be interesting to see what’s next! But for many users, it’s a hopeful happy time since the government that has jailed so many pot smokers since the war on drugs is finally trying to ‘do the right thing’ by pardoning them. This sets in motion the decriminalization of cannabis as a schedule 1 hard drug when all the facts show it is not. In the meantime, many people get their ‘get out of jail free card’ and should be celebrating, but not on federal land yet!

Under Oklahoma law, having the metabolites of cannabis in your system while driving can constitute a DUI. This presents an issue for many Medical Marijuana Patients who need to go about their daily lives. Cannabis metabolites can stay in a person’s system for up to 30 days, so any tests one may take, are not accurate representations of intoxication levels.
If a police officer believes that someone is under the influence of cannabis and the driver tests positive for cannabis at all, then they can be arrested for driving under the influence.
Current field sobriety tests and police technology do not have the capacity to field test cannabis intoxication levels. This is due to the lack of research that has been put into cannabis and its effects. Unlike alcohol, Cannabis doesn’t have the decades worth of testing, marketing, and research to even test products consistently from state to state, let alone field sobriety tests. Once tests are developed to field test THC levels, then it can be regulated similarly to alcohol, but the tech hasn’t quite caught up yet.

Adding cannabis to the recipe is a marriage of two wonderful things and a great example of stoner synergy. It’s what my friends and I made the day we graduated from high school many years ago. Now you can get crispy cereal bars infused with exactly 100 mg of THC in three different flavors from The Mystery Baking company: Original, Chocolate, or Pebble Blast. I chose the Pebble Blast bar for this review. Upon opening the package and unwrapping the treat, you’re immediately hit with the deliciously nostalgic smell of fruity pebbles. A new research project study published in the Journal of Health Economics suggests that States which have legalized recreational use of Marijuana show reduced demand for certain prescription drugs. The study reviewed trends in Medicaid prescriptions in all 50 states between 2011 and 2019, and discovered “significant reductions in the volume of prescriptions” in the drug classes that exist for pain, depression, anxiety, sleep, psychosis, and seizures,” in states that had legalized cannabis versus those that didn’t. Thirty Eight states and the District of Columbia have passed medical cannabis laws (MCL). Out of the states who have legal cannabis, as of 2022, 18 states and DC have passed recreational cannabis laws (RCL).
Shyam Raman, a researcher at Cornell University who co-authored the paper, said the federal government needs to provide the funds for more research. In an email, he stated,“ The first step towards considering cannabis for (opioid) harm reduction is determining what that therapeutic dose looks like and that requires federal funding be made more widely available to pursue thosequestions.” He also stated that the findings so far have indicated that the trend of lower prescription use within the RCL States is tied to “the broader access provided by [recreational cannabis laws],” in that such programs don’t require medical diagnoses or physician recommendations.”
The study found self-reported cannabis use increased 5% following the implementation of MCL, a 13% increase following RCL, and a 25% increase following RCL with active dispensaries. Medicaid recipients in states with RCL reduced prescriptions for depression by 11.1%, for anxiety by 12.2%, for pain by 8%, for seizures by 9.5%. For CBD and other compounds found in the cannabis plant from which it derives its pain relieving properties, the study suggests that for people who take opioids, they could reduce their use by 40-to- 60% if they used cannabis.
There have been several research projects and studies the past few years which can indicate the benefits of cannabis in mitigating opioid and prescription addiction/use:
• In 2021, Canadian Journal of Pain Medicine found that medical marijuana use is associated with significant reductions in dependence on opioids and other prescription drugs, as well as an increase in quality of life.
• A meta-study by University of Arizona’s College of Public Health that was published in 2020 also signaled that marijuana shows promise as a treatment option for chronic pain and could serve as an alternative to opioid based painkillers.
• Researchers at Johns Hopkins released a study the same year that found cannabis can also mitigate symptoms of opioid withdrawal.
• In the 2019 Journal of Health Economics, researchers determined that states with legal marijuana access experience decreases in opioid prescription
• A separate study released the previous month showed that daily marijuana consumption is associated with reduced opioid consumption among chronic pain patients
On a personal note, my brother-in-law who survived stage 4 lymphoma cancer swears cannabis saved his life. The pain from the disease, and the 6 chemo treatments had deteriorated his body and he weighed under 100 pounds before his doctor at UCSF prescribed cannabis. His pain mostly stopped, he gained back his weight, is in remission and is working at 70 years old and doesn’t have an opioid problem. The Cannabis, my wife’s hospice making him eat, and my prayers hopefully contributed.
We’ve come a long way from “Reefer Madness” and from discrimination due to cannabis. After the Mexican Revolution of 1910, Mexican immigrants flooded into the U.S., introducing to American culture the recreational use of marijuana. Nowadays pot is not associated with immigrants as it was in earlier days. Still I can’t wait for the future with no discrimination for cannabis use, along with legalization, but I guess we still have a ways to go.
