Former Trucking Company Employee Pleads Guilty and Seven Former Employees and Two Companies Sentenced in Clean Air Act Conspiracy

On October 23, 2023, in the U.S. District Court for the Western District of Michigan, James Sisson pleaded guilty to conspiracy to violate the Clean Air Act. In April 2023, Sisson was charged along with 10 other individuals and 3 companies for their involvement in a scheme to disable the emissions controls on hundreds of semi-trucks. Tampering with or removing emissions controls can drastically increase the emissions of nitrogen oxides, particulate matter, carbon monoxide, and non-methane hydrocarbons found in vehicle exhaust.

Due to the breadth of data collected by both the Federal Aviation Administration and the Bureau of Transportation Statistics (BTS) on flight delays and cancellations, we are adjusting our audit to focus on the reliability of the flight delay and cancellation data collected by BTS. Our revised audit objective is to assess the controls BTS has in place to ensure the completeness and accuracy of on-time performance and reported causes data.

The Federal Information Security Modernization Act of 2014 (FISMA) requires Federal agencies to implement information security programs. The act also requires agencies to conduct annual independent reviews to determine the effectiveness of their programs and report the reviews’ results to the Office of Management and Budget (OMB). We have contracted with CliftonLarsonAllen LLP, an independent public accounting firm, to conduct the review of the Department of Transportation’s (DOT) information security program for fiscal year 2024, subject to our oversight.




Former Indiana Sheriff’s Deputy Charged and Arrested for NHTSA Grant Fraud

On October 17, 2023, Timothy Butcher was charged via a criminal information in the Lawrence Superior Court, Lawrence County, Indiana, with theft and official misconduct related to mismanagement of National Highway Traffic Safety Administration (NHTSA) grants. Butcher, a former deputy at the Lawrence County Sheriff's Office (LCSO), was arrested on October 26, 2023.
 




Audit Initiated of DOT’s Fiscal Year 2023 Implementation of the Payment Integrity Information Act of 2019

For fiscal year 2022, the Department of Transportation (DOT) reported approximately $61.6 billion in payments for programs and activities susceptible to significant improper payments and estimated about $756 million in improper payments. The Payment Integrity Information Act of 2019 (PIIA) requires Federal agencies to identify, report, and reduce improper payments in their programs and activities. PIIA also requires annual reports by inspectors general on their agencies’ compliance. The Office of Management and Budget (OMB) issues guidance that agencies must follow to implement PIIA.

Tennessee Individual Indicted for Trafficking Counterfeit Airbags From China

On May 11, 2023, a grand jury in the U.S. District Court for the Western District of Tennessee indicted Mohammed Al-Abadi for trafficking counterfeit goods and causing the criminal transportation of hazardous materials by an air carrier. The indictment alleges that, between at least October 2019 and January 2021, Al-Abadi trafficked counterfeit motor vehicle airbag systems and components from China—including airbag inflators, which DOT regulations classify as hazardous materials.




Household Goods Moving Company Entered Into Settlement Agreement for Deceptive Trade Practices

On June 8, 2023, the Florida Attorney General and Steven Ennis, Vice President of Moving Dudes, LLC, entered into an Assurance of Voluntary Compliance (AVC) agreement with a full injunction and civil penalty amount of $1.03 million for engaging in deceptive trade practices related to advertising, marketing, offering, and providing moving services to consumers in Florida and elsewhere.

As the air travel industry began to respond and recover from the effects of the COVID-19 pandemic, it experienced an increase in flight delays and cancellations as well as consumer requests for airline ticket refunds. In the early months of the pandemic, many passengers were reluctant to travel and sought airline ticket refunds, even if their flights were operating as scheduled. Airlines had trouble processing the significant volume of refund requests in a timely manner and were initially reluctant to provide the required refunds.

South Florida Individual Sentenced for Role in Household Goods Moving Fraud

On August 15, 2023, the U.S. District Court for the Southern District of Florida sentenced Avraham Zano to 8 years of incarceration, 3 years of supervised release, forfeiture of $334,499, and a $300 special assessment. Zano was also ordered to pay $2,877,497 in restitution jointly and severally with co-defendant, Sofien Mlayah. In May 2023, Zano pleaded guilty to wire fraud, interstate transportation of stolen property, and failure to give up possession of household goods.




California Individual Pleads Guilty To Transporting Explosives Without a License

On June 26, 2023, in the U.S. District Court for the Central District of California, Erik Armando Ramos pleaded guilty to transporting explosives without a license. Ramos was indicted in December 2022. According to the indictment, Ramos transported flash powder explosives across State borders without a permit from the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF).
 
DOT-OIG is conducting this investigation with ATF.

Letter to Congress on Investigating and Prosecuting Household Goods Moving and Double-Brokering Fraud

In May 2023, eight members of Congress expressed concerns with fraud related to freight-hauling, including stolen truck loads and brokerage fraud schemes. Their letter asked us to consider establishing a permanent task force for investigating, referring, and prosecuting cases of freight, household goods moving, ransom, and double-brokering fraud in coordination with the Federal Motor Carrier Safety Administration (FMCSA) and the Department of Justice (DOJ). Our Office of Investigations has a long and successful history of partnering with FMCSA and the U.S.




Former Massachusetts RMV Branch Manager Sentenced for Fraud Scheme

On August 8, 2023, the U.S. District Court for the District of Massachusetts sentenced Mia Cox-Johnson, a former manager of the Massachusetts Registry of Motor Vehicles (RMV), to 4 months of incarceration and 1 year of supervised release with the first 6 months to be served under home confinement. Cox-Johnson was also ordered to pay a $5,500 fine and a $300 special assessment. On March 30, Cox-Johnson pleaded guilty to two counts of extortion and one count of conspiring to commit extortion.

Audit Initiated of DOT’s Processes for Identifying Surface Transportation Workforce Needs To Implement IIJA

The Infrastructure Investment and Jobs Act (IIJA) invested about $660 billion in funding for new and existing DOT programs—more than twice the amount in the previous 5-year authorization law. In 2022, DOT established a goal to hire 1,400 employees in its surface transportation Operating Administrations (OA) to respond to identified IIJA-related needs between fiscal years 2022 and 2026.
